General terms and conditions of Digital retail

1. – Subject and limitations of the service:

mamba-games.co.uk offers internet users a Video games digital retail Service: an internet user may select a video game, download it, install it on their computer and keep it without a time limit.

The Service consists in the delivery of video games digitally as data files: no physical support, notably CDrom or DVDrom will be sent.

2. – Prerequisites:

The games available to download are from many dozens of megabytes to many gigabytes in size: it is therefore recommended that the user has a broadband line, either ADSL or cable. 

The games require a PC, which has a system specification fulfilling a certain number of requirements (CPU power, RAM, GPU): these specifications are indicated online on a game per game basis. It is the user’s responsibility to check that their PC fulfils the minimum requirements to run the game. If in doubt about the specifications, please go to article 6 - Assistance given with the service.

Mamba Games will not be held responsible for misuse of the downloaded games, nor for their compatibility with the PC of the user.  

3. - Price:

The price of the games offered for download id fixed on a game to game basis and is clearly shown online. The game’s price may be changed at any time, as long as the price shown is that which will used when paying online.

The price shown includes the price of the product plus the VAT applied (rate used will be that at the date of the download).

4. - methods of payment and proof of payment:

The sale is said to have taken place once the user has clicked on the “Submit” button.

The payment is carried out by debit or credit card. No bank or card details are visible by, nor stocked by Mamba Games or on the Site.

The site is secured thanks to:

- SSL (SECURE SOCKETS LAYER) encrypting technology which encrypts the information of the transmission;

- The encrypting functions used by Netscape or Internet Explorer; the internet browser of the user aux;

- The online secure payment system allowing the direct connection of the user’s computer to the payment centre for treatment and authorisation.

- The transaction is carried out following the security norms of the banking sector.

In order to fight against mounting internet fraud, Mamba Games collects and records certain device identifying information and IP addresses, as well as other non-personally identifiable information. In addition, Mamba Games, contracts with certain third party service providers and shares such information with them to provide the safest user experience. This unique official identification contractually binds you. In the absence of fraud this information will remain confidential.

6. - Assistance supplied with the Service:

To receive assistance with the Service or for any questions relation to the download of, the installation of or the payment for your game, please go to the online support pages. If you do not find the answers that you require, you may contact our customer support department at support@mamba-games.com.

In some cases you will be required to give information that was sent to you after your purchase, in order for the customer support department to satisfy your request.

This satisfaction is of top priority, a response will be sent in the shortest possible time.

7. - Terms of use of games and intellectual property:

The payment and the download of the video games give the user an individual licence that is non-exclusive for the use of the video game purchased, for purely private, non transferable and non commercial use.

The user engages to use the game following its conditions of use (and/or EULA) and the current guidelines respecting publisher and author rights.

In consequence, the user is forbidden from modifying, decompiling, translating, adapting and/or copying the downloaded game(s) in any way.

The distribution of non-authorised copies to third parties over the internet or any other network, in nature preventing the development of distribution by download and prevents the copyright holders from any remuneration which would be used for the creation of other titles. In order to prevent fraud the user may only use the games on a limited number of machines (and reinstall a limited number of times). In the event of problems arising from the reasonable re-installation of the games (loss, system alteration, etc.), please go to article 6 - assistance supplied with the service.

The user is free to copy the data downloaded on the user’s computer for any private or personal use, as well as making copies onto a CDrom or any other support for personal archiving.

8. – Continuation of the Service, responsibility:

Mamba Games commits to putting in place all the means at its disposal to assure the continual access to its Service. However Mamba Games cannot guarantee the speed of download of the games, such things are the responsibility not only of the Service but are characteristics inherent to the Internet or the delivery of a third party’s service, notably those of the Internet Service Providers (ISPs).

The Service functions via a technological environment that is under the management and the responsibility of the user, Mamba Games is not responsible for any problems arising from this environment.

Apart form that which concerns the Service which it holds, and aside from the momentary degradation of the quality of the service, notably in the event of maintenance, repair, re-enforcement, extension or improvement of the Service, Mamba Games will not, in any event, be responsible for the reliability of the data transmission, the access speed or any other eventual restrictions of the Service.

In any event, the responsibility and the guarantees of Mamba Games are limited to the replacement of defective games or their eventual reimbursement, not including the compensation for any additional costs, and the granting of damages and interest to any person.

9. - Data protection rights:

The information collected is required for the downloading of the games or for the ease of administration of your eventual questions by the customer support department.

Mamba Games is fully committed to compliance with the Data Protection Act 1998. The following principles will be applied when we handle your personal information:

• Your personal information is only used with your knowledge

• Only information that we actually need is collected

• Your personal information is only seen by those who need it to do their jobs

• We will not pass your personal information on to any other organisation without your agreement unless required to do so by the law

The User may be asked if he/she would like to be added to the mailing lists of our partners with acceptance the User’s details may be passed on to a third party.

During the use of the Service, some statistical information is gathered and transmitted to our partners (game, etc.) but this information does not contain any nominative information about the User, this information is used to asses our service and the average hardware and software capabilities of our users.

A User may request his personal data stored by Mamba Games at any time.
 

10. Epilepsy warning

A very small portion of the population has a condition which may cause them to experience Epileptic seizures or have momentary loss of consciousness when viewing certain kinds of flashing lights or patterns. These persons may experience seizures while watching some kinds of television pictures or playing certain video games. Certain conditions may induce previously undetected Epileptic symptoms even in persons who have no history of prior seizures or epilepsy. If you or anyone in your family has an epileptic condition or has experienced symptoms like an Epileptic condition (e.g. a seizure or loss of awareness), immediately consult your doctor before using any of the software available on this site. We recommend that parents observe their children while they play games. If you or your child experiences any of the following symptoms: dizziness, altered vision, eye or muscle twitching, involuntary movements, loss of awareness, disorientation, or convulsions, DISCONTINUE USE IMMEDIATELY and consult your doctor.

11. - Specific rules on the protection of minors and consumer information:
